Three days after the Pune police submitted a request to a higher court seeking permission to try the 17-year-old juvenile boy as an adult for causing the deaths of two techies, the teenager’s attorney mentioned that the process might last around 90 days.
According to lawyer Prashant Patil, the Juvenile Justice Act (JJA) outlines the procedures to determine whether the accused Child in Conflict with Law (CCL) should be treated as a minor or an adult.
“The process typically takes close to 90 days to complete… If a juvenile or CCL is apprehended, the investigating agencies are required to file a charge sheet within 30 days of the arrest to consider them as an adult. Following the filing of the charge sheet, a two-month process ensues, involving psychological and social evaluations as well as a de-addiction examination,” the lawyer stated, as reported by news agency ANI.
He also mentioned that the accused is not required to stay in rehabilitation during this process.
“In response to the requests from the investigating agencies to amend the granted bail, the Juvenile Justice Board, as per the operative orders, has instructed to place the Child in Conflict with Law in a rehabilitation facility for 14 days, until June 5. We have opposed the request based on academic considerations and legal grounds,” he added.
Patil’s remarks came after the Juvenile Justice Board revoked the teenager’s bail on Wednesday and transferred him to a remand home.
Pune Porsche crash incident
On Sunday morning in Pune’s Kalyani Nagar area, an unfortunate incident occurred when a 17-year-old boy, who was behind the wheel of a Porsche, collided with a motorcycle resulting in the tragic deaths of two individuals identified as Anis Awadhiya and Ashwini Costa. The police, after reviewing the CCTV footage, determined that the young boy was driving the Porsche at a staggering speed of 160 kmph at the time of the accident.
According to the authorities, the teenager had organized a party for his friends on Saturday night to celebrate his Class 12 results. Throughout the evening, the group indulged in drinking at various restaurants in the city and engaged in nighttime drives.
In response to this devastating incident, the Pune police have taken the teen’s father, who is a builder, into custody under the relevant sections of the Motor Vehicles Act (MVA) and the Juvenile Justice Act (JJA) for his alleged failure to fulfill his responsibilities as a guardian. The police claim that the teenager’s father instructed his driver to hand over the keys of the recently purchased Porsche Taycan to his son whenever he requested them. However, the father’s lawyer has refuted these allegations, asserting that the car was given to the driver and not directly to his son.
Furthermore, the police have also apprehended two bar owners for serving alcohol to underage individuals.
