“Legal Friction: Calls for SCBA President’s Removal Amidst Controversial Letter to CJI on Farmers’ Protest”

A group of members from the Supreme Court Bar Association have called for the removal of Adish Aggarwala, the President of the association. This comes after Aggarwala wrote a letter to the Chief Justice of India, urging for suo motu action against the “erring farmers” involved in the Farmers’ Protest. Around 150 lawyers from the Supreme Court have signed a resolution, demanding a general body meeting of the SCBA to discuss the removal of Aggarwala. They argue that he wrote the letter without any authority or capacity in the matter, and misused his position as President of the SCBA by using the association’s letterhead.

Previously, the majority of the Executive Committee members of the SCBA had distanced themselves from Aggarwala’s letter. In a resolution, 13 out of 21 members clarified that the President wrote the letter unilaterally, without consulting the Executive Committee. They expressed disagreement with the contents of the letter and dissociated themselves from it. They also highlighted that the letter, written on the SCBA letterhead, gives a false impression that it represents the opinion of the association.

In his letter to the Chief Justice of India, the President of the Supreme Court Bar Association (SCBA) highlighted that despite the Government of India’s efforts to safeguard the interests of farmers, a group of farmers from Uttar Pradesh, Haryana, and Punjab are currently on their way to Delhi. They are preparing for a large-scale protest in the national capital on February 13.

The SCBA President emphasized that while the farmers may have legitimate demands, they do not have the right to cause inconvenience to the general public. He urged the Hon’ble Supreme Court to take suo motu action and ensure that these farmers do not disrupt the daily lives of citizens or create any disturbances. Expressing suspicion that the protest may have political motivations, the SCBA President called upon the Chief Justice to initiate suo motu action against the farmers who are attempting to forcibly enter Delhi and disrupt the peace.
